• Facilitates communication between buyers and sellers

• Enables social sharing of fragrance preferences

3. User Accounts

To use certain features of the Platform, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Keeping your account information current and accurate

3.2 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that:

3.3 Account Suspension

4. Seller Terms

4.1 Seller Verification

All sellers must complete our verification process, which includes:

• Business registration (if applicable)
• Contact information verification
• Agreement to seller code of conduct

4.2 Listing Requirements

Sellers must ensure their listings:

• Contain accurate product descriptions
• Use authentic product images
• Include current pricing and availability
• Comply with all applicable laws and regulations
• Do not infringe on intellectual property rights

4.3 Seller Responsibilities

Sellers are responsible for:

• Product authenticity and quality
• Accurate product descriptions and pricing
• Timely communication with buyers
• Compliance with all applicable laws
• Handling customer service and returns
• Maintaining appropriate business licenses

4.4 Listing Fees

Sellers agree to pay applicable listing fees as outlined in our fee schedule. Fees are non-refundable once a listing is published.

5. Buyer Terms

5.1 Buyer Responsibilities

Buyers are responsible for:

• Conducting due diligence before making purchases
• Communicating professionally with sellers
• Verifying product authenticity and quality
• Handling all payment transactions directly with sellers
• Resolving disputes directly with sellers

5.2 Contact Information Use

When we provide seller contact information, you agree to:

• Use it only for legitimate purchase inquiries
• Not spam or harass sellers
• Respect seller communication preferences
• Not share contact information with third parties

5.3 Purchase Disclaimers

Buyers acknowledge that:

• All purchases are made directly with sellers
• Chocy does not guarantee product quality or authenticity
• Payment methods and security are between buyer and seller
• Delivery and shipping are arranged by the seller

6. Content Guidelines

6.1 User-Generated Content

Users may post reviews, ratings, comments, and photos. All content must:

• Be truthful and based on genuine experience
• Not contain offensive or inappropriate language
• Respect intellectual property rights
• Not include personal information of others
• Comply with applicable laws and regulations

6.2 Review Guidelines

Product reviews must be:

• Based on actual experience with the product
• Honest and unbiased
• Relevant to the product being reviewed
• Free from promotional content
• Respectful of sellers and other users

6.3 Content Moderation

We reserve the right to remove content that violates these guidelines or is otherwise inappropriate.

7. Prohibited Activities

Users are prohibited from:

8. Payments and Fees

Chocy charges sellers a listing fee for posting products. Current fee schedules are available on our platform and may be updated periodically.

8.2 Payment Processing

Chocy is not responsible for:

• Payment processing or security
• Refunds or chargebacks
• Payment disputes between users
• Currency exchange or conversion

8.3 Fee Changes

We reserve the right to modify our fee structure with 30 days' notice to users.

9. Intellectual Property

9.1 Platform IP

Chocy and its content, features, and functionality are owned by us and protected by intellectual property laws. Users may not:

• Copy, modify, or distribute our content
• Use our trademarks or logos without permission
• Reverse engineer our software
• Create derivative works

9.2 User Content

By posting content on our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with our services.

9.3 DMCA Compliance

We respond to valid DMCA takedown notices. If you believe your intellectual property has been infringed, please contact us with the required information.

11.2 Third-Party Disclaimers

We are not responsible for:

• Actions or omissions of sellers or buyers
• Quality, authenticity, or legality of products
• Accuracy of product descriptions or pricing
• Delivery, shipping, or returns
• Payment processing or security

11.3 User Interactions

All interactions between users occur independently of Chocy. We do not monitor, control, or endorse user communications or transactions.

12. Limitation of Liability

To the maximum extent permitted by law, Chocy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits or revenue
• Data loss or corruption
• Business interruption
• Personal injury or property damage
• Fraudulent transactions

Our total liability for any claim shall not exceed the amount paid by you to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Chocy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your infringement of any third-party rights
• Your interactions with other users
• Your content or product listings

14. Termination

14.1 Termination by Users

You may terminate your account at any time by following the account deletion process on our platform.

14.2 Termination by Chocy

We may terminate or suspend your account immediately if you:

• Violate these Terms
• Engage in prohibited activities
• Fail to pay applicable fees
• Pose a security risk to the platform

14.3 Effect of Termination

Upon termination:

• Your access to the Platform will cease
• Your listings will be removed
• Certain provisions of these Terms will survive

15. Dispute Resolution

15.1 User Disputes

Disputes between users must be resolved directly between the parties. Chocy is not responsible for mediating or resolving user disputes.

15.2 Platform Disputes

For disputes with Chocy, you agree to first attempt resolution through our customer service team. If unsuccessful, disputes will be resolved through binding arbitration in accordance with Uganda law.

15.3 Governing Law

These Terms are governed by the laws of Uganda, without regard to conflict of law principles.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chocy.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.

16.4 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control.
